HOT OFF THE PRESS - 16 December 2011

Tier 2 sponsorship and when to issue Certificates of Sponsorship (CoS)

In order for students to apply for Tier 2 visa they will need to be issued with CoS by the employer. The CoS should not be issued more than 3 months before the student is due to start their pre-registration training otherwise it will expire before the student can use it. Please inform your HR department that the CoS should not be issued until May.

Revised NHS criminal records check standard

The NHS criminal records check standard has been revised and was re-published on 31 January 2011. The revised version makes no amendment to previous requirements but is intended to clarify some of the interim arrangements under the Safeguarding Vulnerable Groups Act in relation to applying for standard CRB checks and proportionality of checks. HOT OFF THE PRESS – 1st October 2010

The new Equality Act 2010 will come into effect on 01 October 2010. The new Act will make asking questions about the health status of an individual applying for a post illegal until after they have been made a conditional offer of a post. The following list outlines the changes that will be made as a result of the new Act:

  • After 01 October 2010, employers are no longer allowed to ask the question “if you have a disability, do you require any specific arrangements to enable you to attend for interview” at the application stage. We have therefore removed this question from our application form for the 2nd round of recruitment taking place in October 2010.
  • Employers are advised to ask all short-listed candidates to inform them prior to interview if they have a disability which requires specific arrangements to enable them to attend the interview. We recommend that employers include the following statement in letters inviting candidates for interview for the 2nd round of recruitment “if you have a disability and require any specific arrangements to enable you to attend for interview, please inform the hospital prior to the interview”. For the second round of recruitment we have also updated the ‘invited for interview’ email (that we send to students when you short-list online on the Pharmalife website)to include this statement.
  • After 01 October 2010, employers are no longer allowed to ask about absence or attendance records prior to a conditional offer of employment being made. Therefore for the 2nd round we have removed the question / information from the academic reference about the student’s attendance record.
  • Pre-employment Health Questionnaires will no longer be used routinely – please contact your local Occupational Health department for more information about this.
  • Offers of employment used to state that the offer was subject to Occupational Health Clearance but employers will not be allowed to write this in offer’s of employment after 01 October 2010. Please discuss what information should be included in an offer of employment with your local Human Resources department. NHS Employers has provided guidance on what information to include in offer’s of employment.

The following list outlines what will NOT change as a result of the new Equality Act:

  • Employers may still ask questions about disability as part of equality monitoring. This data is collected separately from the application form. The data is also anonymised and reported separately from the application form. Therefore applicants will still complete an equality monitoring form alongside their application, and employers will still be able to view equality monitoring reports online on the Pharmalife website.
  • Employers may still ask disabled applicants whether they wish to be considered under the Guaranteed Interview Scheme. Therefore we have retained the following question in our application form "If you have a disability, do you wish to be considered under the Guaranteed Interview Scheme if you meet the minimum criteria as specified in the Person Specification?" Guaranteed Interview Scheme
